I-129F Form

The Form I-129F or Petition for Alien Fiancee is used for a number of purposes. It is used to petition to bring your fiancee (K1 Visa) and that person’s children to the US for marriage to you amongst other applications. You search this website for more information.

You will note that the Form I-129F or Petition for Alien Fiancée is an application form used by U.S. citizens to petition for their fiancée to come to the US to get married. This immigration application form is used as the first step in the K-1 visa process. Once your fiancee enters the US you have 90 days to get married.

The form requires the following information to start:

Your Personal information

The full names as well as the birth dates and address of you and your fiancee. Note that it all has to be in English except the name of your foreign spouse which can be in the local characters of his/her language.

Proof of Citizenship

As the petitioner, you will need to prove that you are an American citizen or a permanent resident. This can be your birth certificate or your certificate of naturalization.

Evidence of a real relationship

This takes up most of the documents. Letter and emails you wrote to each other. Also evidence of telephone calls and photos together. You can now also add video chats as well as shared expenses. Some couple live together while abroad.

Proof of financial support

Accordingly you will need to show that your meet the US visa financial requirements. This can be tax returns, bank statements or confirmation of salaries. You need to be above 125% above the poverty line. Active US military personal only need to make 100% of the poverty line.

Statement from you the petitioner

Basically explain why you are not getting married abroad and why in the US.

Take a look at the checklist as these are the most common items forgotten:

• Are all the sections of the form that apply to you completed?
• Did you sign the form as well as date the form?
• Nowe check the fee and ensure that it is correct?

These are important and you need to check what the fees are as they have increased over the years. As for documents you will also need to check these which you are submitting. Lets see what are the most basic items:

Also did you add all the photographs to show a relationship (normal outside and inside ones)?
Have you added your birth certificate to prove of your US citizenship.?
Did you add the proof or original statements of intent to marry from both you and your fiancée?
Also have you added your divorce decree or death certificate of your last spouse for you and your fiancee?

Proof that you and your fiancé(e) have met in person within two years before filing Form I-129F.
Completed Form G-28 (only if you are represented by an attorney or an accredited representative).
Additionally certified English translations of any non-English documents.*

*(very important – translator or certifier must be identified. Notary must have a notary certificate attached to documents)
